Judge denies PACT appeal

The U.S. District Court judge for Western New York, Richard Arcara, will not suspend PACT act mailing restrictions for Seneca Nation of Indians retailers.

Members of the Seneca Free Trade Association and one independent Seneca tobacco retailer, Aaron Pierce, had asked the judge to grant them temporary exemption from PACT while they try to have it declared unconstitutional in a higher federal court.

It wasn't all bad news for Seneca retailers. The judge also denied a request by government attorneys to suspend another earlier ruling of his that temporarily exempts Seneca retailers from complying with taxing regulations in other localities.
